Partners in Preservation Historic Places Terms of Participation

Who May Participate: Anyone 13 years of age or older may participate. Program is void where prohibited and subject to all applicable federal, state and local laws. An eligible minor should have his/her parent’s or legal guardian’s permission to participate.

Program Period: Program begins on April 24, 2013 at 12:01am Eastern Time (“ET”) and ends on May 10 at 11:59pm ET (“Program Period”).

How to Participate:

Create a User Account: During the Program Period, visit www.partnersinpreservation.com (“Website”) and follow the directions provided to establish a user account, then follow the directions to earn points for one of the historic places featured on the Website. Limit one (1) user account per person/email address. Accounts generated by script, macro or other automated means or any other means that subvert the registration process, as determined by Sponsor (as defined below) in its sole discretion, may be void.

How to Earn Points For Participating Historic Places: You can earn points for your favorite historic place through the methods described below, including voting for the place on the Website and engaging in certain social media activities. In order to earn points for the historic places via Twitter, Instagram and/or Foursquare (“Social Media Accounts”), you must link the applicable social media account with your user account on the Website by following the directions provided within your user account settings on the Website. Each historic place has been assigned a unique hashtag which may be required for certain point earning methods. These hashtags can be found on the Website. Activities undertaken by you through any Social Media Account that has not been linked with your user account on the Website will not result in points for the historic place you selected. Votes/points obtained by any fraudulent or inappropriate means, including, without limitation, payment for votes/points or offering to trade votes/points, as determined by Sponsor, in its sole discretion, may result in those votes/points being void and the historic place and/or participant at issue being disqualified.

Note: You can choose to earn points for one or more historic places; however, you can only earn points via each method below one time per day, regardless of how many historic places for which you choose to earn points in a given day. For example, you can vote for one historic place and post a photo on Instagram using a different historic place’s unique hashtag on that same day; however, you cannot vote for more than one historic place in any day or use more than one unique hashtag on Instagram in any given day to earn points; any such points will be void.

Vote: Visit the Website, login to your account and vote for your favorite historic place. You will earn 50 points for your favorite historic place. Limit one (1) vote per day per person/user account.

Check in on Foursquare: Stop by your favorite historic place and check in via your linked Foursquare account to earn 10 points for that historic place. Limit one (1) check-in per day per person/user account.

Post Photos on Instagram: Post a photo on Instagram via your linked Instagram account and tag that photo with your favorite historic place’s unique hashtag to earn 10 points for that historic place. Limit one (1) photo post per day per person/user account. You should have all necessary rights and permissions to post any photo in connection with this program and to grant the license set forth below.

Photo License: By posting a photo on Instagram using a historic place’s unique hashtag, you hereby grant to Sponsor a nonexclusive license to reproduce, distribute, display, perform, create derivative works based upon, or otherwise exploit the photo in any manner or media now known or hereafter devised (including, without limitation, in a gallery on the Website) throughout the world in perpetuity for advertising, promotional and other purposes, without further compensation, notification or permission. You agree that Released Parties (as defined below) are not responsible for any unauthorized use of photos by third parties. Sponsor has no obligation to make use of the rights granted herein. You agree to set the license settings for photo to allow for this grant of rights.

Tweet: Earn 10 points with a Tweet via your linked Twitter account using your favorite historic place’s unique hashtag (as set forth on the Website). Limit one (1) Tweet per day per person/user account. Only retweets from registered users will trigger additional points.

Votes/points or any point earning activity generated by script, macro or other automated means or any other means intended to impact the integrity of the voting/point earning process as determined by Sponsor may be void. Any post via any Social Media Account must comply with the Terms of Use for that platform as well as the Prohibited Program Guidelines set forth below. Sponsor reserves the right to disqualify any post and/revoke points awarded for any post that they determine do not comply with these rules and/or guidelines or which are not in keeping with the spirit of the program, as determined by Sponsor in its sole discretion. Note that the number of points shown on any leader board on the Website is not definitive and subject to change based on Sponsor’s review of qualifying activities. The decision of the Sponsor with respect to the tallying of votes/points, and the invalidation or disqualification of any suspected votes/points, shall be final.

PROHIBITED CONTENT GUIDELINES: Posts may not contain, as determined by the Sponsor, in its sole discretion, any content that:

  • is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity;
  • promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;
  • is obscene or offensive; endorses any form of hate or hate group;
  • defames, misrepresents or contains disparaging remarks about Sponsor, its products or services, other people or companies;
  • contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission, to the extent permission is necessary;
  • contains copyrighted materials owned by others (including music, photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media), without permission, to the extent permission is necessary;
  • contains materials embodying the names, likenesses, voices, or other indicia identifying any person (living or dead), such as license plate numbers, personal names, e-mail addresses or street addresses, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission, to the extent permission is necessary;
  • communicates messages or images inconsistent with the positive images and/or good will with which Sponsor wish to associate; and/or
  • violates any law.

Release of Liability: By participating, you (and, if an eligible minor, your parent or legal guardian) agree to release, indemnify, discharge and hold harmless National Trust for Historic Preservation (“Sponsor”), American Express Company, Twitter, Foursquare and Instagram and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from your participation in the program or any program-related activity, and/or Sponsor’s use of the rights granted herein.

General Conditions: Released Parties are not responsible for lost, late, misdirected, undelivered, garbled, incomplete, inaccurate, stolen or delayed votes/points or for incorrect/inaccurate point information or any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, votes/points. Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any vote or Social Media Account post to be tabulated on account of technical problems, human error or traffic congestion on the website, or any combination thereof or for any other reason. Released Parties are also not responsible for any injury or damage to participant’s or any other person’s computer relating to or resulting from participation or downloading any materials. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVESTHE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES (INCLUSING, WITHOUT LIMITATION, ATTORNEYS’ FEES) FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right, in its sole discretion, to modify, terminate, or suspend the program or void any vote/points/post should a virus, bug, non-authorized human intervention, action of any historic place or individual, or other cause corrupt or impair the administration, security, or fairness of the program. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be violating these terms, tampering with the participation process, or acting in an unsportsmanlike or improper manner and void all associated votes/points/posts.
